These terms cover the NUKIX app. Purchases on nukix.com are covered by our Store Terms of Service and Returns & Refunds policy.

These Terms of Use are an agreement between you and Footwear Foundationz Inc. ("NUKIX", "we", "us"), which operates the NUKIX app. They apply to everyone who uses the app in Canada or the United States. Please read them carefully. By ticking "I agree" and creating or continuing to use an account, you accept them.

1. What NUKIX does

NUKIX helps parents, clinics and retailers understand foot posture and walking patterns. You take photos of the feet and a short walking video with your phone's camera. The app analyses them, with the help of automated and artificial-intelligence tools, and produces reports, exercises and product suggestions such as insoles and footwear.

Some features let you buy recommended products. Purchases are completed on our online store, which runs on Shopify.

2. Not medical advice

NUKIX is a general wellness and information tool. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Reports describe what the analysis observed; they are not a medical opinion.

Results can be wrong or incomplete, for example because of lighting, camera angle, clothing, movement or the limits of the technology. Always consult a qualified health professional, such as a physician, podiatrist, chiropodist or physiotherapist, about pain, injury or any medical concern, and before making decisions about treatment. Never ignore or delay professional advice because of something in the app. If you think there is a medical emergency, call 911 or your local emergency number.

3. Who can use NUKIX

You must be at least the age of majority where you live (18 in most provinces and states, 19 in some) to create an account. Children do not use the app themselves.

A parent or legal guardian may create profiles for their children and scan them. By doing so you confirm that you are the child's parent or legal guardian, or are otherwise authorized to act for them, and that you consent on their behalf to the collection and use of their information as described in our Privacy Policy. For children under 14 (in Quebec) or under 13 (elsewhere), this parental consent is required by law.

4. Clinic and retailer accounts

Clinic and retailer accounts are by invitation. We review each registration and, if approved, send an activation PIN. We may decline or withdraw access at our discretion. For questions, contact accounts@nukix.com.

If you use NUKIX for patients or customers, you are responsible for: obtaining their consent (or their parent's or guardian's consent) before scanning them or entering their information; meeting the professional, privacy and health-information laws that apply to you, such as PHIPA, provincial health-information laws or HIPAA; and your own professional judgment. NUKIX results support, and do not replace, your assessment.

You must keep your staff's use of the account under your control and tell us promptly if you believe it has been misused.

5. Your account

Give accurate information and keep it up to date. Keep your password private; you are responsible for activity under your account. Tell us promptly at support@nukix.com if you suspect unauthorized use.

You can delete your account at any time in Settings. Deletion is described in our Privacy Policy.

6. Acceptable use

Use NUKIX only for its intended purpose and in line with the law. Do not: scan anyone without the consent required above; upload anything other than feet and walking scans; upload content that is unlawful, harmful or infringes anyone's rights; try to access other people's data or our systems without permission; copy, reverse engineer or resell the app or its results; or interfere with how the app works.

7. Your content

You keep ownership of the photos, videos and information you provide. You give us a non-exclusive licence to store, process and use them to provide the app to you, to support you, and as described in our Privacy Policy. This licence ends when the content is deleted, except for copies we must keep by law.

You confirm you have the right to provide this content, including any consent needed from the people shown in it.

8. Purchases

Products recommended in the app are sold through our online store. Prices, taxes, shipping, returns and refunds are shown at checkout and are governed by the store's policies. Payments are processed by Shopify and its payment partners; NUKIX does not receive your full card details.

A recommendation is a suggestion, not a guarantee that a product will suit you. Check sizing and fit, and ask a health professional where appropriate.

9. Our rights

The app, its design, software, reports and content belong to NUKIX or its licensors and are protected by law. We give you a personal, non-transferable, revocable right to use the app under these Terms.

10. Availability and changes to the app

We work to keep NUKIX available and accurate, but we do not promise it will always be available, uninterrupted or error-free. We may change, suspend or stop features at any time.

We may suspend or close an account that breaks these Terms or puts others at risk. Where reasonable, we will tell you first.

11. Disclaimers

To the extent permitted by law, the app and its results are provided "as is" and "as available", without warranties of any kind, including warranties of accuracy, merchantability or fitness for a particular purpose.

Some provinces and states do not allow certain warranties to be excluded. Where that applies, the exclusion applies only as far as the law allows, and nothing in these Terms limits rights you have under consumer-protection law.

12. Limitation of liability

To the extent permitted by law, NUKIX is not liable for indirect, incidental, special or consequential damages, or for decisions made based on the app's results. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100 (or USD $100 in the United States).

These limits do not apply where the law does not allow them, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

If you use NUKIX for patients or customers, or break these Terms or the law, you agree to cover NUKIX's reasonable losses and costs from claims that result, to the extent permitted by law.

14. Changes to these Terms

We may update these Terms. When we do, the app will show you the new version and ask you to accept it before you continue. If you do not accept, you can stop using NUKIX and delete your account.

15. Law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live elsewhere in Canada or in the United States, you keep the protection of the mandatory consumer-protection laws of your province or state, including Quebec, and may bring a claim where the law gives you that right.
